On November 14, 2018, the United States Environmental Protection Agency (“U.S. EPA”) published its proposed rule regarding the Determinations of Attainment by the Attainment Date, Extensions of the Attainment Date, and Reclassification of Several Areas Classified as Moderate for the 2008 Ozone National Ambient Air Quality Standards in the Federal Register.
In its proposed rule, U.S. EPA notes that seven areas failed to attain the air quality standards by the attainment date, including Chicago-Naperville, Illinois-Indiana-Wisconsin. The U.S. EPA proposes to reclassify these areas from “moderate” to “serious” nonattainment by operation of law upon the effective date of the final reclassification notice. Comments on the proposed rule are due by December 14, 2018. USEPA will hold a public hearing if anyone requests a public hearing on or before November 29, 2018.
