What Illinois Manufacturers Need to Know About California’s Proposition 65

“California’s so-called “Prop 65” law is the common nickname for California’s Safe Drinking Water and Toxic Enforcement Act of 1986. Prop 65 requires a set of specific and distinct warnings to be placed on “consumer products” that reveal whether the product contains any one of more than 900 chemicals on California’s disclosure list (which is frequently updated and expanded), which the state believes cause cancer or reproductive harm, and to which consumers could be environmentally exposed….  But what started out as a way to educate consumers about toxic chemicals that are contained in everyday products has increased compliance costs for manufacturers and transformed into a feast for private trial lawyers who are authorized under the law to sue (and recover their attorneys’ fees from) any company that fails to comply – whether such companies manufacture parts or products within California or not.”  Source:  The Illinois Manufacturer, Second Quarter 2019
